Terms & Conditions — MAYAS

1. General Information
These Terms & Conditions ("Terms") govern your access to and use of the MAYAS international webshop (mayas.co) and any affiliated online storefronts operated by MAYAS, including any purchases made through them.

By accessing or using the MAYAS website, or by placing an order, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have read, understood, and agree to be bound by these Terms, and that you have the legal capacity to enter into a binding agreement. If you do not agree, please do not use the website or place an order.
NOTICE: FOR CUSTOMERS IN THE UNITED STATES — THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER IN SECTION 23. BY USING THE WEBSITE OR PLACING AN ORDER, YOU AGREE TO RESOLVE DISPUTES WITH MAYAS THROUGH INDIVIDUAL ARBITRATION AND WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS. PLEASE READ SECTION 23 CAREFULLY.
Formation of Contract
Your order constitutes an offer to purchase. A binding contract is formed only when MAYAS sends you an order confirmation or shipping confirmation via email. MAYAS reserves the right to decline or cancel any order prior to shipment for any reason, including but not limited to stock unavailability, pricing errors, suspected fraud, or compliance with applicable trade sanctions and export control laws.
2. Pricing & Currency
All prices are displayed in USD (or the applicable local currency as shown at checkout) and include any applicable taxes unless otherwise stated at checkout. Import duties and customs fees are included in the purchase price (DDP — Delivered Duty Paid); you will not be charged additional duties upon delivery.
MAYAS reserves the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time of checkout. We reserve the right to cancel orders affected by pricing errors and will notify you promptly if this occurs.
Prices displayed in currencies other than the base store currency are indicative and subject to exchange rate fluctuations. The final charge may vary slightly depending on your payment provider's conversion rate. Any currency conversion fees applied by your bank or payment provider are your responsibility.
3. Payment
MAYAS accepts payment via Visa, Mastercard, Apple Pay, Google Pay, and any other methods displayed at checkout. Payment is charged at the time of shipment.
All transactions are processed in the currency displayed at checkout. Your bank may apply a currency conversion fee — this is outside MAYAS's control.
MAYAS reserves the right to cancel or refuse any order where fraud is suspected.
Sanctions & Export Compliance
All orders are subject to applicable international trade sanctions and export control laws. MAYAS reserves the right to refuse or cancel orders destined for restricted countries, territories, or individuals as designated by the European Union, United States, United Nations, or other applicable authorities. No goods will be shipped in violation of such restrictions.
4. Pre-Orders & Backorders
MAYAS may periodically offer pre-orders for products not yet in stock. When you place a pre-order:
- Your payment method will be charged in full at the time of order placement.
- Estimated delivery dates are provided in good faith but are not guaranteed. Actual delivery may be subject to production and supply chain timelines.
- You may cancel a pre-order free of charge at any time before the item has shipped by using the cancellation link provided in your order confirmation email, or by contacting info@mayas.co.
- Once the item has shipped, the standard return policy below applies.
- If MAYAS is unable to fulfill a pre-order, you will be notified and issued a full refund to your original payment method.
5. Shipping & Delivery
MAYAS ships internationally. All international orders are shipped DDP (Delivered Duty Paid), meaning MAYAS covers import duties and customs fees. You will not be charged additional fees upon delivery.
Delivery timelines vary by destination and shipping method. Estimated delivery times are displayed at checkout and are not guaranteed. MAYAS is not liable for delays caused by carriers, customs processing, or events beyond our control.
Risk of loss and title for all products passes to you upon transfer of the shipment to the carrier. MAYAS is not liable for any loss, damage, or delay that occurs after the order has been handed to the shipping carrier. If a package is marked as delivered by the carrier but you have not received it, please contact info@mayas.co within 7 days of the delivery date. MAYAS will assist in filing a carrier claim where possible but is not obligated to replace or refund shipments confirmed as delivered or lost in transit by the carrier.
If you refuse delivery or fail to collect a package from the designated pickup point, MAYAS will attempt redelivery. If delivery fails a second time, any costs incurred for redelivery or return to sender will be deducted from your refund.
6. Returns & Right of Withdrawal
6.1 Return Window
You have 14 days from the date of delivery to initiate a return. The return period begins:
- On the day you receive the order.
- On the day you receive the last item, if multiple items from one order are delivered separately.
- On the day you receive the last shipment or part, if an item is delivered in multiple parts.
- On the day the order is delivered to your designated pickup point, if applicable.
Customers in the European Union and the United Kingdom: This return policy does not affect your statutory right of withdrawal under applicable consumer protection law. If you are located in the EU or UK, you have a legal right to withdraw from your purchase within 14 days without giving a reason. To exercise this right, please contact info@mayas.co or use the returns portal before the expiration of the withdrawal period.
6.2 How to Initiate a Return
All returns must be initiated through our returns portal at returnflows.com/mayas-co. You may not return items by simply refusing delivery without first notifying MAYAS through the portal.
Do not arrange your own return shipping outside of the returns portal. MAYAS assumes no responsibility for items returned without using the designated process, including items that are lost, damaged, or delivered to an incorrect address.
6.3 Return Shipping Costs & Liability
Return shipping is at your expense unless the item is defective (see Section 8). You bear all risk of loss, damage, or delay for items in return transit. MAYAS is not liable for any items lost, stolen, or damaged during return shipment, regardless of the shipping method used — including cases where you have purchased a return shipping label through MAYAS or a MAYAS-affiliated returns service. We strongly recommend using a trackable shipping method and retaining proof of postage. MAYAS cannot process a refund for returned items that do not arrive at our facility.
6.4 Processing & Inspection Fee
The first 2 items per order may be returned at no additional fee. For each additional item returned beyond the second, a processing and inspection fee of $2.00 USD per item applies. This fee will be deducted from your refund.
6.5 Condition of Returned Items
Items must be returned in their original condition — unworn, unwashed, and with all tags attached. You may try on items as you would in a physical store (e.g. briefly try on for fit).
Hygiene seal requirement: Swimwear and certain intimate apparel items are shipped with a hygiene seal. Items where the hygiene seal has been removed or broken are not eligible for return and will not be refunded.
If an item is returned in a condition that shows use beyond reasonable try-on, MAYAS reserves the right, at its sole discretion, to:
- Apply a value reduction of up to 50% of the item's purchase price and refund the remaining balance.
- Offer the full return value as MAYAS store credit in lieu of a monetary refund.
- Reject the return entirely if the item has been worn, washed, or damaged. In this case, MAYAS will notify you and offer to return the item to you at your expense. If you do not request the item back within 14 days of notification, MAYAS may dispose of it.
MAYAS's assessment of an item's condition is final.
6.6 Items Excluded from Returns
The following items are non-returnable:
- Sale items. All items purchased at a discounted or sale price are final sale and non-returnable, unless explicitly stated otherwise at the time of purchase.
- Items where the hygiene seal has been removed or broken.
- Items made to your specifications or clearly personalized.
- Gift cards.
- Items that have been worn, washed, altered, or damaged after delivery.
6.7 Promotional Gifts
If your order included a free promotional gift, that gift must be returned in unused, original condition along with the purchased items. If the gift is not returned, its full retail value will be deducted from your refund.
7. Refunds
7.1 Refund Timeline
Refunds are processed within 14 business days of MAYAS receiving the returned item(s) at our facility. MAYAS may withhold the refund until the returned item has been received and inspected.
7.2 Refund Method
You may choose to receive your refund via:
- Original payment method — refunded to the same payment instrument used at checkout.
- MAYAS store credit — issued for use on future purchases.
Please indicate your preference when initiating the return. If no preference is stated, the refund will be issued to the original payment method.
7.3 Partial Refunds
MAYAS may issue a partial refund if:
- The returned item shows signs of use beyond reasonable try-on.
- Return fees apply (see Section 6.4).
- A promotional gift was not returned (see Section 6.7).
- Redelivery costs were incurred due to refused or uncollected delivery (see Section 5).
7.4 Refunds on Orders Paid with Gift Cards
If your order was paid fully with a MAYAS gift card, the refund will be credited back to your gift card balance. For orders paid partially with a gift card and partially with another payment method, the refund is allocated as follows: the value of retained items is first applied against the gift card payment, and any remaining refund amount is returned to the other payment method used.
8. Manufacturing Defect Guarantee
MAYAS guarantees all products against manufacturing defects (e.g. faulty stitching, fabric tears, hardware failure) for 45 days from the date of delivery.
If you discover a manufacturing defect within this period:
- Contact info@mayas.co with your order number and photos of the defect.
- MAYAS will, at its discretion, offer a replacement, exchange, store credit, or refund.
- Return shipping for defective items will be covered by MAYAS.
This guarantee does not cover damage caused by normal wear and tear, improper care, misuse, or failure to follow care instructions. This guarantee is in addition to, and does not replace, any mandatory statutory rights in your jurisdiction.
9. Gift Cards & Store Credit
9.1 General Terms
MAYAS gift cards are issued by MAYAS ApS. Gift cards represent a stored value and are not e-money. They are not subject to financial regulatory protections.
9.2 Redemption
Gift cards can be redeemed at checkout on mayas.co for eligible products. A gift card cannot be used to purchase another gift card.
9.3 Validity
Gift cards are valid for 5 years from the date of purchase. They cannot be redeemed for cash or refunded if lost or damaged.
9.4 Activation
Gift cards are typically activated within 24 hours of purchase.
9.5 Application at Checkout
Gift cards must be applied before completing your order. They cannot be applied retroactively to existing orders.
10. Discount Codes
Discount codes are issued in connection with promotional campaigns and are valid only during the specified period. Discount codes cannot be purchased.
- A minimum order value may be required as specified on the code.
- Discount codes cannot be used to purchase gift cards.
- Discount codes cannot be combined unless explicitly stated otherwise.
- Discount codes are non-transferable and non-refundable.
- If you return items from an order where a discount code was applied and the remaining order value falls below the discount threshold, MAYAS reserves the right to charge the original (undiscounted) price for the items you retain.
11. Product Information
MAYAS makes every effort to ensure that product descriptions, images, and sizing information on our website are accurate. However, slight variations in color, texture, or fit may occur due to screen display differences and the nature of handcrafted or semi-handcrafted products. Such variations do not constitute a defect.
WE DO NOT GUARANTEE THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE INFORMATION ON THE WEBSITE, INCLUDING PRICES, PRODUCT IMAGES, DESCRIPTIONS, SPECIFICATIONS, AND AVAILABILITY. WE RESERVE THE RIGHT TO CORRECT ERRORS, INACCURACIES, OR OMISSIONS AND TO CHANGE OR UPDATE INFORMATION AT ANY TIME WITHOUT PRIOR NOTICE, INCLUDING AFTER YOU HAVE SUBMITTED AN ORDER.
12. Intellectual Property
All content on mayas.co — including but not limited to the MAYAS name, logo, trademarks, product designs, photography, copy, and website design — is the property of MAYAS ApS or its licensors and is protected by applicable intellectual property laws. The trademarks displayed on the website may not be used without prior written permission from the applicable rights holder.
Subject to these Terms, MAYAS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the website and its content for your personal, non-commercial use only — specifically for the purpose of browsing, placing orders, and using the website as a shopping resource. This license does not include the right to reproduce, distribute, modify, publicly display, or commercially exploit any MAYAS content. Unauthorized use may result in legal action.
13. User-Generated Content
By submitting any content through the MAYAS website or associated channels — including product reviews, photographs, videos, comments, or social media posts tagged with MAYAS handles or hashtags (each a "Submission") — you certify that: (i) your Submission is original and you have all necessary rights to it; (ii) your Submission does not violate the intellectual property, privacy, or other rights of any third party; (iii) your Submission does not contain material that is abusive, defamatory, obscene, or knowingly false; and (iv) your Submission does not include personally identifiable information about any third party without their consent.
By providing a Submission, you grant MAYAS a non-exclusive, perpetual, irrevocable, transferable, and sublicensable worldwide right and license to use, reproduce, modify, display, distribute, and otherwise exploit your Submission in all media, with or without attribution, and you hereby waive all moral rights therein. MAYAS is not obligated to use or compensate you for any Submission. MAYAS reserves the right to edit or remove any Submission at its sole discretion. Your name or social media handle may be displayed alongside your Submission.
14. Prohibited Conduct
You agree to use the MAYAS website only for lawful purposes and in accordance with these Terms. You may not:
- Use the website in any manner that could damage, disable, or impair it, or interfere with any other party's use.
- Attempt to gain unauthorized access to the website, its servers, or any connected systems through hacking, password mining, or other means.
- Use automated tools, bots, scrapers, spiders, or data-mining software to access, crawl, or index any part of the website or its content.
- Create accounts by automated means or under false pretenses.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload, transmit, or distribute any viruses, malware, or other harmful code.
- Use the website for any commercial purpose other than personal shopping, including unauthorized resale or distribution of MAYAS products.
- Remove, alter, or obscure any copyright, trademark, or proprietary notices on the website.
MAYAS reserves the right to restrict or terminate your access to the website if you engage in any prohibited conduct.
15. Third-Party Links
The MAYAS website may contain links to third-party websites, applications, or services, including payment processors, shipping carriers, and return service providers. These links are provided for your convenience only. MAYAS does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site. Your use of any linked third-party site is at your own risk and subject to that site's own terms and policies. MAYAS is not liable for any loss or damage arising from your use of or reliance on any third-party site.
16. Website Disclaimer
THE MAYAS WEBSITE AND ALL CONTENT, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAYAS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
MAYAS DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT ANY DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE WEBSITE IS AT YOUR SOLE RISK.
17. Limitation of Liability
To the maximum extent permitted by applicable law:
- MAYAS's total liability arising from or in connection with any order shall not exceed the purchase price of the item(s) in question.
- MAYAS is not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profit, data, or opportunity.
18. Force Majeure
MAYAS shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond MAYAS's reasonable control, including but not limited to natural disasters, pandemics, epidemics, wars, terrorism, civil unrest, government actions or sanctions, port congestion, carrier strikes, supplier delays, power outages, or disruptions to telecommunications or internet services. MAYAS's obligations shall be suspended for the duration of such event, and MAYAS will make reasonable efforts to notify affected customers and resume performance as soon as practicable.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold MAYAS ApS, its affiliates, and their respective employees, directors, officers, and agents harmless from and against any claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with: (i) your use or misuse of the website, products, or services; (ii) your breach of these Terms; (iii) your violation of any applicable law, rule, or regulation; (iv) your failure to follow product care instructions; or (v) any customs, tax, or regulatory issues specific to your jurisdiction. This clause does not limit any mandatory statutory rights that cannot be excluded by contract in your jurisdiction.
20. Communications & Notices
All official communications from MAYAS — including order confirmations, shipping notifications, return updates, and dispute correspondence — will be sent to the email address you provide at checkout. It is your responsibility to ensure this email address is current and monitored. MAYAS is not liable for missed communications resulting from an incorrect or inactive email address.
21. Account Termination
MAYAS reserves the right, in its sole discretion and without prior notice or liability, to issue a warning, temporarily suspend, or permanently terminate your customer account for any reason, including but not limited to violation of these Terms, suspected fraud, abusive behavior toward MAYAS staff, or conduct that MAYAS deems harmful to its business or other customers. In the event of account termination, MAYAS may delete data associated with your account. MAYAS has no further obligations to you following termination of your account. You agree that MAYAS will not be liable to you or any third party for any such termination.
22. Governing Law & Disputes
These Terms are governed by the laws of Denmark, without regard to its conflict of laws principles.
However: Nothing in these Terms is intended to limit or exclude any mandatory consumer protection rights that apply in your jurisdiction and that cannot be waived or limited by contract. Where such mandatory local rights apply, they shall prevail over any conflicting provision in these Terms.
Any dispute arising from or in connection with these Terms that cannot be resolved amicably shall be submitted to the competent courts of Denmark, unless mandatory law in your jurisdiction requires otherwise.
23. Arbitration & Class Action Waiver (United States Customers)
This section applies only to customers located in the United States.
23.1 Agreement to Arbitrate
Any and all disputes, claims, or controversies arising out of or relating to these Terms, your use of the MAYAS website, or any products purchased through it (a "Dispute"), shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. By agreeing to these Terms, you waive your right to a trial by jury.
23.2 Pre-Arbitration Resolution
Before initiating arbitration, the disputing party must first send a written notice describing the nature and basis of the Dispute, together with the relief sought, to the other party by email (to info@mayas.co for notices to MAYAS). The parties shall attempt to resolve the Dispute in good faith for 30 days following receipt of the notice. If the Dispute is not resolved within that period, either party may commence arbitration.
23.3 Arbitration Process
Arbitration shall be administered by a recognized arbitration provider agreed upon by the parties, or if no agreement can be reached, by a provider with jurisdiction in the claimant's region. The arbitration shall be conducted before a single arbitrator, in the English language, and may be conducted by video conference or on the basis of written submissions at the claimant's election. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
23.4 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MAYAS AGREE THAT ANY DISPUTES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
23.5 Enforceability
If the class action waiver in Section 23.4 is found to be unenforceable, the entirety of this arbitration section shall be null and void, and the Dispute shall be resolved in accordance with Section 22.
24. Privacy & Data
MAYAS collects and processes personal data necessary to fulfill your order and handle related inquiries. This includes your name, address, phone number, email address, and purchase history.
For full details on how your data is collected, processed, stored, and your rights as a data subject, please refer to our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to our Privacy Policy.
25. Changes to These Terms
MAYAS reserves the right to update these Terms at any time. Changes take effect upon publication on mayas.co. The version in effect at the time of your order applies to that order. Continued use of the webshop after changes are published constitutes acceptance of the revised Terms.
26. Complaints & Dispute Resolution
If you have a complaint about a product or order, please contact us at info@mayas.co.
If you are a consumer residing in the European Union and are unable to resolve a complaint directly with MAYAS, you may submit a complaint through the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. When submitting a complaint, please include our email address: info@mayas.co.
27. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms to the minimum extent necessary. All remaining provisions shall continue in full force and effect.
28. Entire Agreement
These Terms, together with the MAYAS Privacy Policy, constitute the entire agreement between you and MAYAS ApS with respect to your use of the webshop and any purchases made through it. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. No statement, representation, or promise made by MAYAS outside of these Terms shall be binding unless confirmed in writing by MAYAS ApS.
29. Assignment
MAYAS may assign these Terms at any time to a subsidiary, parent company, affiliate, or successor entity as part of a merger, acquisition, reorganization, or sale of all or substantially all of its assets or business — including, without limitation, the transfer of customer orders and obligations from MAYAS ApS to a MAYAS-affiliated entity in another jurisdiction. You may not assign or transfer your rights or obligations under these Terms without MAYAS's prior written consent.
